Bihar MLC defection controversy: A political controversy has erupted in Bihar after newly elected Legislative Council members Banshidhar Brajwasi and Rahul Raj extended their support to the Bharatiya Janata Party (BJP).
Rashtriya Janata Dal (RJD) leader Tejashwi Yadav has demanded the disqualification of both MLCs.
He cited the anti-defection provisions under the Tenth Schedule of the Indian Constitution.
RJD MP Manoj Jha has also approached the Legislative Council Chairman with a formal complaint.
He has indicated that the party may move court over the matter.
RJD Questions the Constitutional Validity
Tejashwi Yadav argues that the two legislators cannot change their political allegiance without facing the consequences under anti-defection rules.
The RJD believes their decision amounts to a violation of the constitutional provisions governing elected representatives.
The party wants the Legislative Council to examine the matter and take appropriate action.
Manoj Jha has taken the issue further.
He has submitted a complaint to the Legislative Council Chairman and raised the possibility of legal proceedings.
The controversy has now brought the interpretation of the Tenth Schedule into the centre of Bihar’s political debate.
BJP Clarifies its Position
The BJP initially triggered speculation about the formal induction of the two MLCs into the party.
However, the party later clarified its position.
It said that Brajwasi and Rahul Raj had extended their support to the BJP.
Banshidhar Brajwasi also clarified that he had not formally joined the BJP.
He maintained that he had only extended his support to the party.
BJP Bihar president Sanjay Saraogi also changed his social media post following the controversy.
The change added another dimension to the political debate.
