Legal Notice Raises Questions Over BCCI Secretary Devajit Saikia’s Dual Roles

Serious allegations against the BCCI Secretary: Naresh Himmat Lal Makani, a life member of the Jharkhand State Cricket Association (JSCA) and a former cricketer, has raised legal questions about BCCI Secretary Devajit Saikia’s dual roles.

Saikia also serves as the Advocate General of Assam.

Makani argues that the simultaneous responsibilities require independent judicial scrutiny to determine his eligibility and address any potential conflict of interest.

Legal Notice Sent to BCCI

Makani has served a formal legal notice on the Board of Control for Cricket in India (BCCI).

He is also preparing to file a petition before the Bombay High Court.

The proposed legal action seeks an examination of the Supreme Court’s order dated August 9, and the recommendations of the Lodha Committee.

The committee’s recommendations formed part of the reforms in cricket administration.

Makani wants clarity on whether a person holding a constitutional office, such as a state’s Advocate General, can simultaneously serve as BCCI Secretary.

He has called for an examination of the relevant constitutional provisions, rules governing advocates and the BCCI Constitution.

Focus on Transparency and Accountability

Makani said the matter concerns the credibility of cricket administration rather than a personal campaign against any individual.

He stressed that sports governing bodies must uphold transparency, accountability and compliance with applicable laws.

He also called for the equal application of legal standards to every office-bearer.

According to Makani, judicial scrutiny should resolve any ambiguity over the interpretation or compliance of the relevant rules.

BCCI Asked to Clarify Its Position

Makani has urged the BCCI to respond formally to his legal notice.

He wants the board to explain its position on compliance with the applicable rules and judicial orders.

He also reiterated that authorities must determine the eligibility of cricket administrators strictly under the law.
